1. What I Received

I received a copy of the title insurance commitment identified above (the "Commitment"), and was told that copies of every recorded document listed in Schedule B are available from Atlantic Title Firm on request.

2. What I Understand

The owner's title policy will be issued subject to every exception listed in Schedule B, Part II of the Commitment, and will not insure against loss from those matters. Schedule B exceptions may include restrictions, covenants and conditions; easements, rights-of-way and utility rights; HOA or condominium declarations, assessments and rules; setback lines; mineral, oil and gas rights; agreements and plat matters; and the standard exceptions for parties in possession, survey matters (unless a survey is provided and the exception is removed), unrecorded easements, construction liens not of record, and taxes for the current and later years. These matters may limit how I can use, build on, rent or improve the Property, for example limits on fences, pools, short-term rentals, parking, pets or additions. The title search covers the public records; matters not of record, and matters a survey or inspection would reveal, may not be covered.

3. My Review and Acceptance

I have reviewed the Commitment, including every Schedule B exception, or have had the full opportunity to review it and to request copies of the exception documents. I accept title subject to those exceptions. I was advised that ATF does not give legal advice about the meaning or effect of any exception and that I may consult an attorney of my choice before closing. I raised any objections in writing before signing.

4. Release and General Terms

Release

I release, hold harmless and will indemnify Atlantic Title Firm, LLC and its owners, officers, directors, employees and agents ("ATF") from any claim, loss, cost or expense, including reasonable attorneys' fees, arising from any matter shown as an exception in the Commitment or the policy, even if the claim is based in whole or in part on the negligence of ATF. This release does not apply to ATF's own gross negligence or willful misconduct.

General

This document survives closing, binds heirs, personal representatives, successors and assigns, and is governed by Florida law, with venue in St. Lucie County, Florida. Each signer will pay all reasonable attorneys' fees, paralegal fees and costs ATF incurs to collect any amount that signer owes under this document or to enforce that signer's obligations under it, whether or not suit is filed, including on appeal and in bankruptcy. If any part is unenforceable, the rest remains in effect.

JURY WAIVER: EACH SIGNER AND ATF KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATING TO THIS DOCUMENT OR THE CLOSING.
