Citizenship & FIRPTA

Are you a citizen of the United States?

If you are a foreign person, the sale may be subject to FIRPTA (Foreign Investment in Real Property Tax Act). Generally, 15% of the sales price is withheld from proceeds at closing and remitted to the IRS within 20 days unless an exemption applies or a withholding certificate is obtained beforehand. Please let us know early so we can advise you.

Closing

How would you like to close?

For a mail-away closing, your documents must be signed in the presence of a notary public. Use of personal notaries is not allowed.

Existing Mortgages

Is there an existing mortgage on the property?

Condo / Homeowners' Association

I understand that I will be responsible to pay for any estoppel fees that the association demands.

Existing Title & Survey

Do you have a copy of your Title Insurance Policy?
Do you have a copy of your Survey & Elevation Certificate (if a single-family home)?
Any improvements to the property or adjoining neighboring properties since the date of the survey?

1031 Exchange & Entity Sellers

Are you engaging in a 1031 Exchange?

If title is held by an entity, please provide: Corporation — Articles of Incorporation, current Certificate of Good Standing, and a corporate resolution naming authorized signers. Partnership — the Partnership Agreement. LLC — the Articles of Organization.

Documents & Identity Verification

Take a photo with your phone or upload a file (JPG, PNG, HEIC, or PDF — up to 20 MB each). To verify your identity, we'll need a government-issued photo ID such as your driver's license or passport.
