2. I Read Every Page

I understand that the summary or first page of the Report may not list every item, and that open, expired or unfinalized permits, code cases, fines, utility charges and special assessments may appear only on later pages, in attachments or in individual department responses. I have read, or had the full opportunity to read, every page of the Report, and I am not relying on any summary prepared by the search company, ATF, a real estate licensee or anyone else.

4. Release, Final Acknowledgment & Agreement

Release

The Report was prepared by the search company from information supplied by government agencies and utilities, not by ATF. ATF does not verify it and makes no warranty about it. I release, hold harmless and will indemnify Atlantic Title Firm, LLC and its owners, officers, directors, employees and agents ("ATF") from any claim, loss or expense, including reasonable attorneys' fees, arising from any item shown on any page of the Report, or from any error, omission or delay in the Report, even if the claim is based in whole or in part on the negligence of ATF, including any claim that ATF failed to point out an item. This does not apply to ATF's own gross negligence or willful misconduct or limit my rights under any title insurance policy.

General

This document survives closing, binds heirs, personal representatives, successors and assigns, and is governed by Florida law, with venue in St. Lucie County, Florida. Each signer will pay all reasonable attorneys' fees, paralegal fees and costs ATF incurs to collect any amount that signer owes under this document or to enforce that signer's obligations under it, whether or not suit is filed, including on appeal and in bankruptcy. If any part is unenforceable, the rest remains in effect.

JURY WAIVER: EACH SIGNER AND ATF KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATING TO THIS DOCUMENT OR THE CLOSING.

Final Acknowledgment and Hold Harmless

I confirm that I HAVE REVIEWED THE ENTIRE LIEN AND PERMIT SEARCH, every page, and I ACCEPT THE PROPERTY SUBJECT TO ALL LIENS, OPEN OR EXPIRED PERMITS, CODE VIOLATIONS, FINES AND CHARGES SHOWN IN IT (except only items I listed above to be resolved before closing). I HOLD ATLANTIC TITLE FIRM HARMLESS from any claim, loss or expense arising from any of them.
