Under the federal Real Estate Settlement Procedures Act (RESPA), no one can require you to use a particular title company as a condition of the sale. A realtor, lender, or builder may suggest one, and that's fine — but the choice is yours. On new construction, a builder can offer incentives to use their affiliate, yet still can't force it.
