Orange follows the majority Florida custom — the seller customarily pays for the owner’s title policy, which keeps buyer costs lower here than in the seven buyer-pays counties.

Who Pays for Title Insurance in Orange County?

The seller does, by long-standing local custom. That matches 60 of Florida’s 67 counties. The exceptions are Miami-Dade, Broward, Sarasota, Collier, Lee, Charlotte and Manatee, where the buyer pays.

It matters twice over. It decides who carries the premium, and because Florida practice holds that whoever pays for the owner’s policy customarily chooses the closing agent, in Orange County that choice normally belongs to the seller. Custom is a default, not a rule — the FAR/BAR contract lets the parties allocate it however they agree.

Property Taxes Vary Widely Across Orange

Orange County has 95 separate taxing districts, and the spread is large. Bay Lake (mill code 70) runs at 26.5315 mills while Bay Lake (mill code 35) sits at 14.1079. On a $450,000 home that is about $4,969 a year between two identically priced properties in the same county.

These are taxing districts, not just incorporated cities. Florida property tax is levied by district, and many of the largest residential markets in a county are unincorporated communities with no city government of their own — they still carry a distinct total millage because of the county services, fire and water management districts that overlay them. On the buyer side: lender origination and discount points, appraisal, credit report and underwriting, commonly $3,000–$6,000 on a conventional loan; prepaid interest; the first year of homeowner’s insurance; and escrow reserves. In Florida, insurance is often the most volatile line and on coastal property can exceed every title charge combined.

On the seller side: real estate commission, typically 5–6%. On a $450,000 sale that is $22,500–$27,000, several times every other seller line together. Add the mortgage payoff, municipal lien items and any repair credits.

How to Lower Your Closing Costs in Orange County

Ask for the reissue rate

If the property was insured within the last three years, Florida’s promulgated schedule allows a reissue rate on the new owner’s policy. It is never applied automatically — someone must produce the prior policy and ask, before the settlement statement is final. Here the saving normally benefits the seller, who customarily pays the premium.

Shop the fees, not the premium

Florida promulgates the title premium, so every licensed agency charges the same for the policy itself. What is not regulated is the settlement fee, lien search, courier and document preparation. Those vary company to company and are where real differences appear. Ask for those lines specifically.

Paying cash changes the math

A cash purchase records no note, so there is no doc stamp on the note, no intangible tax, no lender’s policy and no lender fees. Set the loan amount to zero above and the buyer figure typically drops by more than half. A cash buyer should still take an owner’s policy — no lender is requiring one, which is exactly why it gets skipped and exactly why it matters.

What a Title Search Covers in Orange County

Before any Florida closing funds, the title has to be examined back through the public record. In Orange County that search runs the Official Records maintained by the Clerk of the Circuit Court, and it is looking for anything that would survive the sale and attach to you as the new owner.

The most common findings are unreleased prior mortgages, where a lender was paid off years ago but never recorded the satisfaction; judgment and tax liens against the seller; open or expired building permits, which surface on the municipal lien search rather than the title search; and easements and restrictions recorded against the parcel. Each has to be cleared or specifically excepted before a policy issues.

The searches that matter most are ordered separately. A title search covers the recorded chain; a municipal lien search covers code enforcement, utility balances and open permits that never reach the Official Records. Skipping the second is how buyers inherit a five-figure code enforcement lien on a property that looked clean.

How Long a Orange County Closing Takes

A financed Orange County purchase typically runs 30 to 45 days from executed contract to closing, and a cash purchase can close in two to three weeks once the title work is back. The timeline is set by whichever of three tracks finishes last: lender underwriting, the title search and any cure work, and the association estoppel if there is one.

The single biggest cause of delay is ordering late. Title work and the municipal lien search should be ordered the week you go under contract, not the week before closing. Nearly every title problem is solvable with time, and almost none are solvable in forty-eight hours — an unreleased mortgage needs a payoff and a recorded satisfaction, a missing heir needs probate, an open permit runs on the municipality’s calendar rather than yours.

Condominium purchases add the estoppel letter. Florida statute caps the fee and sets a delivery deadline, but a slow association is still one of the most common reasons a closing date slips. Order it immediately.
