Tennessee Mail-Away & Remote Closings

You do not have to be in Tennessee to buy or sell there. Mail-away and remote closings are routine — here is how they work, what Tennessee law permits on remote notarization, and the three items that decide whether the file closes on time.

What a mail-away closing actually is

A mail-away closing is one where you never walk into an office. The closing package is prepared, sent to you wherever you are, signed and notarised there, and returned for recording and disbursement. Tennessee handles these routinely, and for an out-of-state buyer or seller it is usually the default rather than the exception.

The mechanics are simple but the sequencing matters. We send the package once figures are final, you sign in front of a notary, the originals come back by overnight courier, and funds disburse when the deed and deed of trust are recorded with the county Register of Deeds. Nothing about being out of state slows that down — what slows it down is starting the identification and payoff steps late.

Tennessee permits remote online notarization

Tennessee authorises remote online notarization under the Online Notary Public Act, Tenn. Code Ann. § 8-16-301 et seq., in force since July 2019. A Tennessee notary must hold a separate online notary commission issued by the Secretary of State to perform them.

More useful for anyone signing from another state: Tennessee recognises online notarizations properly performed by notaries commissioned in other states. That means a signer in Tennessee, Texas or anywhere else with a valid RON framework can often complete a Tennessee closing from a laptop rather than hunting for a notary in an unfamiliar city.

Two caveats worth knowing before you plan around it. The buyer’s lender has the final say — some still require wet-ink signatures on the deed of trust regardless of what state law permits. And practice varies between county Registers of Deeds on accepting electronically notarised instruments. We confirm both at the start of the file rather than the week of closing.

The three things that decide whether it closes on time

Identification, early. Every party needs government photo identification, and for a remote signing it needs to satisfy the notary’s credential analysis. Send it in week one. This is the single most common cause of a delayed remote closing, and it is entirely avoidable.

Payoff authorisation, earlier. If there is a loan to satisfy, we cannot request the payoff until the borrower signs an authorisation — privacy rules prevent the servicer releasing it to us otherwise. Servicers commonly take five to ten business days, and some take considerably longer. On a mail-away file where nothing can be handed over in person, that lead time is the constraint.

Wire verification, always by phone. We will call you on a number we source ourselves to confirm wiring instructions, and we ask you to call us before sending anything. Remote closings are the preferred target for closing-funds fraud precisely because the parties never meet. If you receive wiring instructions from us by email and they have changed, they did not come from us.

Selling Tennessee property you inherited or moved away from

A large share of the mail-away files we handle are sellers who no longer live in Tennessee — someone who relocated years ago, or heirs selling a parent’s house from another state. Those transactions carry one recurring complication worth flagging early.

If a deceased owner is still on the deed, the sale cannot close until title is cleared. Depending on the circumstances that means an affidavit of heirship, a completed probate, or corrective deeds signed by every heir — and locating every heir is the slow part, particularly across state lines. If a parent or grandparent is still named on the deed, tell us in the first conversation rather than after the search comes back.

The second is the deed of trust release. Tennessee secures loans with a deed of trust, and the release must come from the trustee or a properly appointed substitute trustee. A release signed by the wrong party does not clear the lien, and that surfaces at the worst possible moment.
